ROACH UP IN SMOKE? NOT UNTIL THE FAT LADY.. IS STONED..
I Intend to appeal. this may be fun.. If i can get the right people on board..
Arguing "WHAT IS 'IS'"; and freedom of speech - that a candidate on a political ballot, running for a political office cant call themselves or go by any legal name. A Legal Name is precise. a nickname - can be anything you want.
A preponderance of evidence? A reasonable doubt? A Free Speech Issue?
A discussion of the propriety of a GOP Complaintant, the ACEB deciding an democrat Primary election? Shouldn't the Primary Voters decide?
"Pro- Choice" Smith; "Gun Rights" Jones ; "Semper Fi" Burns; You name it.
"Legalize- Marijuana" last name- Blunt? Wead? Stoner? Bong? Roach All legitimate names; plausible if there is Marijuana slang attached..
I have over a dozen blog Posts, Roach4Commissioner.blogspot.com teling the story.
Link to these 2 (safe for work blog pages where i have researched and discuss the issue at length.. and thank you to the Afternoon tabloid media, for their patience and giving me all the (HEMP?) rope I want.

I intend to appeal, on grounds that the Indiana law cited is vague, and imprecise, and subject to interpretation. The ACEB did not rule on the LETTER OF THE LAW which allows great lee way , as compared to other states, which are precisely worded, and have narrowly defined descriptions of what constitutes a nickname, and what does not. According to the letter of Indiana law- basically , the only "nicknames you cant use are Doctor; Professor; Reverend; and such. I once knew a local blues Musician with the nickname "Governor". would that be exempted?

A nickname has cost perennial candidate Dave Roach a spot on the May 8 primary ballot, handing the Democrat Party nomination for Allen County Commissioner to retired firefighter Gordon Anthony.
“A candidate’s nickname (on the ballot) is supposed to be a name by which they are commonly known,” Director of Elections Beth Dlug said, explaining why the Election Board last week ruled the nickname Roach included in his filing application – “Legalize Marijuana” – to be invalid.
Because the candidate-filing deadline had already passed, Roach could not resubmit the paperwork, effectively removing him from the ballot. He could still appeal the board’s decision in court, however, Dlug said.
Dlug said the board acted in response to a Republican challenge to Roach’s nickname. County GOP Party Chairman Steve Shine told The News-Sentinel last month he considered Roach’s unusual ballot identification to be a political statement, not a true nickname. “That was intended for things like ‘Bob,’ ” he said.
Anthony was an unsuccessful City Council candidate last year.

Looks like we won't have Allen County's merry prankster of politics to kick around this year:

Not sure why Shine did that. Someone running as "legalize Marijuana" doesn't exactly make the Democrats look good, you know? And Roach can't use the occasion of a political contest to make a political statement? Hmmmm.
