            David Christopher Roach One of the three board members for the Olin B. and Desta Schwab Foundation has resigned his post after revelations it had bought a luxury home outside Las Vegas.
            
            John Dortch, president and CEO of the Preston Joan Group, a human resources consulting firm, quit the foundation board the day after a Journal Gazette investigation detailed the purchase of a $1.5 million house in a gated compound in an exclusive resort, he said. He had been on the board since the mid-1990s.The other board members are Jon Garver, who lives in Prairieville, La., and attorney Richard H. Blaich, whose Fort Wayne law firm "terminated any remaining ties" with him the same day Dortch quit the board.

            Dortch did, however, say he abstained from votes on more than $100,000 worth of foundation grants to organizations he is connected to and said the foundation's tax return stating he was paid $12,375 for an average of four hours a week is incorrect.
            
            "That's really not a right number," Dortch said, but would not elaborate.

            David Christopher Roach According to foundation tax returns for the fiscal years ending June 30, 2004, and June 30, 2003, the foundation gave two $21,000 grants to the Alpha Phi Alpha fraternity in Fort Wayne for its Alpha Tyme program, which mentors minority boys.
            
            Dortch is active in Alpha Phi Alpha and organized its first two Black Leadership Summits.
            
            The tax returns also show the foundation gave two $30,000 grants to Lakeside Middle School when Dortch's wife, Anita Jennings Dortch, was still the principal there. She has since retired, but according to the 2003 tax return, she was paid $5,000 to update the foundation's Financial Aid Handbook, a guide to college financial aid.
            
            John Dortch said he abstained from voting on those grants and was not involved in the decision to hire his wife.
            
            "No, you have to abstain yourself," John Dortch said. "I would never get myself in that."
            
            Dortch confirmed that a foundation board meeting was held at the house in Lake Las Vegas but declined to say whether he knew the house was foundation property.
            
            Dortch's longtime attorney, M. Randall Spencer, said he will not allow Dortch to speak publicly until he completes his own investigation.
            
            "I have no knowledge of what we're going to find," Spencer said, but added he is sure it will mean vindication for Dortch.
            
            "I'm just trying to find out what did happen, and until that time I don't want to have contradictory statements in the press," Spencer said. "Until I know John's answers on those issues I can't have him speaking."
            
            Spencer said his investigation could take a month.

            In the meantime, Blaich, president of the foundation's board, has been removed from his law firm.
            
            Craig Patterson, managing partner at Beckman Lawson LLP, said the firm "severed all remaining ties with Rich Blaich," after learning of information reported by The Journal Gazette.
            
            "To see something like that was shocking, and we don't condone that kind of behavior as alleged," Patterson said.
            
            Blaich retired from the firm a year ago but was still "of counsel" there, which is a sort of semi-retirement where he was listed among the firm's lawyers and occasionally handled cases. That relationship ended Aug. 29, the day after The Journal Gazette's investigation was published, Patterson said.
            
            Blaich, reached at his home in Roanoke, declined to comment.
            
            The Schwab Foundation, however, whose address is inside Beckman Lawson's suite of offices at 200 E. Main St., continues to be located there.
            
            "The Schwab Foundation is still a sub-tenant of our firm," Patterson said. "They rent space, have their own furniture, their own computer, their own phone line."
            
            Patterson, however, could not say whether the $32,095 in legal fees listed as an expense on the foundation's tax return was work done by Blaich or Beckman Lawson. Because the foundation had been a client of the firm in the past, Patterson said, those fees, if they were Beckman Lawson fees, would be protected by attorney-client confidentiality rules.
            
            `Our Sorrento home'
            
            In a previous interview, Blaich said the Lake Las Vegas house is a legitimate investment for the foundation and denied it is a vacation home.
            
            But in an August 2004 Las Vegas Review-Journal newspaper article, Blaich called the house in the Sorrento neighborhood a second home and said he may retire there. On Aug. 29 he told The Journal Gazette his statements to the Review-Journal were not true and were made only at the request of the neighborhood's developer, Centex Destination Properties. Centex, Blaich claimed, agreed to complete free repairs to the house in return for the good press Blaich's interview would bring.
            
            But Blaich has since declined to answer questions about another Las Vegas newspaper article in which he was quoted nearly a year before the August 2004 story.
            
            In a Nov. 8, 2003, story in the Review-Journal's Real Estate section, Blaich called the house his home and said he loves living on the Reflection Bay Golf Course near the Ritz-Carlton hotel and shops designed to look like an Italian village.
            
            "Sorrento was a perfect fit for our active lifestyle, a very good mix of everything we were looking for in a resort home," the paper quoted Blaich as saying. "From our home, we can walk to MonteLago Village for morning coffee, the golfing options are literally just outside our back yard ... We couldn't be happier with our Sorrento home."
            
            Blaich would not explain his statements in the other article.
            
            "I don't want to hang up on you, but I told you, I'm just not going to add anything to your story," Blaich said.
            
            The property-tax bills on the house are sent quarterly and are mailed directly to the home. The phone at the house is in Blaich's name.
            
            Increased scrutiny
            
            Even if the house is not a vacation or retirement home for the foundation's president, the investment is a questionable one, experts say.
            
            Robert A. Katz, an associate professor of law and philanthropic studies at the Indiana University School of Law in Indianapolis who teaches courses on the laws governing non-profits, trusts and estates, said the line between charitable use and personal gain will be closely examined by regulators.
            
            "Even if it's the (foundation's) headquarters and he's living there or spending vacation time there, that's private inurement," Katz said. "That's wealth that the foundation is transferring to him."
            
            Even if board members were paying rent to the foundation for using the house, Katz said, it would likely violate the Internal Revenue Service's ban on foundations doing business with people connected to the foundation.
            
            "These types of arrangements are really frowned upon," Katz said. "He could be staying there and paying twice the market rate, but if it's a private foundation, even that is dubious. It's bad news all around."
            
            Evelyn Brody, a professor at Chicago-Kent School of Law and a national expert on tax-exempt agencies and the laws governing them, said there are no hard and fast rules on what foundations can invest in, but those investments need to be prudent and examined in terms of what else could be done with the money.
            
            For the Schwab Foundation, the $1.5 million house makes up about 20 percent of its assets, and owning it costs the foundation more than $100,000 a year in property taxes, neighborhood association dues and the loss of income from interest and dividends on securities it sold when the house was purchased.
            
            "(The house) has no charitable purpose, so it has to be just the numbers," Brody said. "It's fair to say that there's stricter scrutiny brought to bear when there's an interested party involved or when it benefits somebody who's an insider."

            Investigations continue
            
            Staci Schneider, spokeswoman for Indiana Attorney General Steve Carter, said that office's investigation into the Schwab Foundation continues.
            
            Right now, the office is investigating how the foundation's move to Nevada may affect jurisdiction. The foundation was formed in Fort Wayne in 1989, but in 2003, a new foundation with the same name, board members and address was formed in Nevada. The Indiana foundation was later merged into the Nevada entity and then the Indiana foundation was dissolved.
            
            "It does complicate things, but it's something we are looking into and researching very carefully in how to approach it," Schneider said. "The acts that occurred were when they were an Indiana foundation, so that is probably to our advantage."
            
            Nevada Attorney General spokeswoman Nicole Moon said that office cannot investigate until a complaint is filed, and as of Wednesday it had not received any.
